00:00So one of the lawyer commented on the victim that
00:03Does rising rape cases depends on what the woman wear?
00:30If the rapist does not consider the age of the female he is assaulting, why does Indian
00:47judiciary system care about the age of that boy?
00:51You are very right here and there is
00:54So my name is Naseema Muzawar.
01:04So before asking my question, I had to say this thing about the Nirbhaya rape case.
01:10So one of the lawyer commented on the victim that
01:13So about that I have to ask
01:19Does the rape, rising rape cases depends on what the woman wear about the clothing?
01:27Do you have a mental asylum in Goa?
01:31You go there and you'll be recording all kinds of statements
01:37Should we be discussing those statements?
01:41Do we need to glorify those statements with this stage?
01:46So somebody comes and says,
01:48Some madman is uttering something
01:57Why should you be bothered?
02:01Are you a Mithahi Ka Dabba?
02:04What kind of analogy is this?
02:06Mithahi Ka Dabba?
02:07I understand somebody is making that statement that statement tells about that person
02:16Not anything about you
02:18A madman is uttering gibberish
02:26You listen to the gibberish, that gibberish tells you something about the madman
02:32Not about the woman that gibberish is aimed at
02:36Which is aimed at?
02:40Not getting it?
02:44Any idiot can say anything!
02:48Learn to ignore!
02:49When it comes to wisdom teachers of the world, I am probably the most trolled one
02:58Most hated one
03:00Most hated one
03:02They are all the time hurling abusers at me
03:04Even as we sit here right this moment
03:07There will be somebody making a video
03:08Acharya Prashant exposed
03:09Do I need to bother?
03:14And now that I am talking to you here on this stage
03:17When this goes out again
03:19They will take clips and say, you know, he is misleading all the gullible girls of this country
03:25Now there will be no more sanskari
03:27Now there will be no more sanskari
03:31Kill this man!
03:36They actually send death threats
03:41Do I need to bother?
03:43Then why do you bother?
03:51See, at most they can succeed
03:54That's fine
03:55That's fine. They'll bring an end to your life, right? Your life comes to an end. But
04:04at least it would be a life well lived. What's the point in elongating your life when that
04:11life is only drudgery? You're always in chains and living a long life. What dignity is there?
04:21Simple. You can kill me but you cannot stop me. Nobody is going to kill you. Don't worry.
04:28Don't worry.
04:30Hello sir. My name is Saundarya Patil and I have a question regarding the Nirbhaya rape
04:39case and almost many rape cases followed have a similar kind of relation with that. Sir,
04:45in Nirbhaya rape case, there were six accused men. Okay. One among them was a 17 year old
04:52boy. Okay. But still, I don't know why the judiciary system said that his okay he is a juvenile.
05:00But if the rapist does not consider the age of the female he is assaulting, then why does
05:06Indian judiciary system look after, why does Indian judiciary system care about the age of
05:12that boy to say that he is a juvenile or so? Do we actually need that statement when the
05:18mindset of that 17 year old boy is so horrible that it is almost, we can like we can just end
05:26his life, right? For that mindset first of all. You are very right here and there is a
05:36problem. But we have to understand the position of the judge on this. The judge cannot change
05:47the law on his own. If the law says that a juvenile cannot be punished in such and such way,
05:56what can the judge do? The maximum that the court can do is clearly say that this person is
06:05definitely guilty. But as per the existing provisions of the law, he cannot be punished or he can
06:11be punished only till this point. That's the maximum that the court can do. So we cannot blame
06:16the court here. Are you getting it? But yes, the law can be amended. The law can be amended
06:25because if a 16 or 17 year old is committing a rape, then in his own eyes, he is not a juvenile.
06:34If you are just a juvenile, how are you so needful of sexual intercourse? That kind of urge does not
06:48characterize a juvenile or does it? So when it comes to offences like murder or rape, it would be my opinion
06:58that nobody should be considered a juvenile. At least not a teenager. Maybe if you are eight or ten or something, you can be kind of pardoned or sent to a reform home or something. But if you are a teenager and you commit a murder or rape, then I don't think that physically, mentally, existentially, you are a teenager.
07:20But we cannot blame the court. Also, even if you amend the law, it cannot be applied retrospectively. Which means if the law has been changed today, you cannot apply it to a back date.
07:42You cannot apply it to a back date. So what can we do? Maybe, maybe all those rules were made in better times. When people below 18 usually didn't turn out rapists. But times have changed. So probably laws need to change.
08:04Two of you have spoken. Two of you have spoken of the Nirbhaya case here. We know how horrible, how gruesome and you must have been kids when that happened.
08:24Right? That was more than 10 years back. You would have been little girls at that time. And I can, I can imagine that the imprint, the scar it left on your mind. I can see that.
08:37But also, please understand. Nobody is going to offer you security. Right? There is no benevolent power out somewhere, whether in the family, or in the society, or in the political system,
09:06or judicial one, or judicial one, or even up out there in the skies. There is no benevolent power anywhere for you. You are on your own. Every single creature is on her own.
09:19I am on my own. You are on my own. That does not mean that there can be no love. Yes, love is possible. But not between dependent beings.
09:36When you are dependent, then first of all, you are miserable. Secondly, you also become exploitative. I am dependent in some way. Just for the sake of the example. I am dependent on this mic right now.
09:52You see what I am doing to it? You see what I am doing to this mic? What am I doing? Clutching it. With all determination, all care. Can I afford to let it slip? Yes. So when you are dependent on somebody, you clutch. And then all the time you are peeping into his phone.
10:18I will not let him slip away. And then you think that's a joke. The man is looking at another girl. And the girlfriend gets jealous and angry.
10:32And says you stop looking at her. Come to me. You think of that as some kind of biological nature. No, that is not biological nature.
10:42That is a social system that has handicapped you. You know if your husband is gone. Your finances are gone. Therefore, you will guard your husband.
10:54Very, very, very strongly. Very, very, very possessively. It's not love. It's dependence. In love, you often allow the other to fly free. But if you are acting as that possessive wife or girlfriend or whatever, that is also because you are dependent.
11:20Dependent. And that is violence. Is it not? So if you are dependent, you are the recipient of violence. Equally, you are inflicting violence.
11:32You are receiving violence and you are giving violence. And all that only because you are dependent. In dependence, love is not possible.
11:45Independence, it would be violence and ownership masquerading as love. And that is the story of most relationships and most households. Is that not?
12:01Is that not getting it? So, so don't, don't expect goodies coming you away from somewhere. That's how you saw it in the movies, right?
12:12Somebody just comes and gifts you a bungalow. That's not going to happen. Huh? My father loves me so much. He is gifting me this. He is gifting me that. Rest assured, you will not get your share of the patriarchal property.
12:34You will be sent off with the dowry and you are so happy. You know, he has given me so much. He has given me so much. These days, you don't even want to call it dowry.
12:45You say this is a gift from my father. Yes, you have received that gift. And now you forego your share in the father's property. You have to be on your own.
13:03You have to be on your own. Only then love is possible.
