00:00It's really bewildering why the state of Tennessee will not simply answer the question
00:04whether the same position will be present for the upcoming execution.
00:08A convicted murderer who's been sitting on death row for 40 years,
00:12scheduled for lethal injection amid concerns about Tennessee's Department of Corrections
00:16after a separate execution was aborted in May when executioners couldn't properly administer an IV.
00:22Here's what we know about the planned capital punishment of Anthony Darrell Hines
00:26and the controversy surrounding a previously failed lethal injection.
00:30The state of Tennessee is set to move forward with a lethal injection execution on August 13th,
00:35even after a recent controversy rocked the state's Department of Corrections.
00:3866-year-old Anthony Darrell Hines, who's set to be executed at 11 a.m. Thursday
00:43at Nashville's River Bend Maximum Security Institution, was sentenced to death in 1986
00:48for the murder of Catherine Jean Jackson Jenkins, a motel worker whose body was discovered
00:53in one of the motel's rooms with multiple knife wounds to her chest.
00:57Hines was nabbed as the main suspect after being found with Jenkins' broken-down car
01:01on the side of the road and dried blood on his shirt.
01:05According to the Nashville Banner, Hines admitted to taking Jenkins' car, but denied the murder.
01:10Despite a jury convicting Hines of felony murder in 1986, the 66-year-old has maintained his innocence.
01:16Governor Bill Lee has denied Hines' request for clemency.
01:19But Hines' execution is surrounded by controversy, after lawyers and advocates raised concerns
01:24about the state's execution team.
01:26In May, executioners failed to properly establish a backup IV line on Tony Caruthers,
01:32another death row inmate forcing the execution to be aborted.
01:36According to the Death Penalty Information Center, a primary IV line was quickly established,
01:41but when team members tried to install a required backup line, Caruthers was punctured,
01:45quote, more than a dozen times, for more than an hour.
01:49After the backup line failed, a doctor struggled to also establish a central line.
01:54They pierced him all over his arms, his legs, his feet, and they still were not able to access a
01:59vein.
01:59So at that point, they asked a physician to step in, a physician who's a member of the execution team,
02:04to put in an intravenous line, a central line, through which they could deliver the lethal injection drugs.
02:11And that physician tried for over an hour, but was unable to place that line.
02:16Governor Lee issued Caruthers a one-year reprieve because of the failed execution attempt.
02:21According to WSMV, two months after the failed execution, Caruthers' sister alleged in a complaint
02:26that the botched lethal injection caused her brother to suffer a brain stroke that left him partially paralyzed.
02:32She accused the execution team's doctor, Dr. Mark Walton Fowler,
02:37who failed to establish a central line, with malpractice and torture.
02:41Lawyers are now trying to use the botched execution to delay Heinz's injection.
02:45According to the Tennessee Lookout, Heinz's lawyers have petitioned the Supreme Court
02:49to postpone the execution because of Dr. Fowler's, quote,
02:52incompetence and inexperience,
02:54which could violate Heinz's Eighth Amendment rights against suffering cruel and unusual punishment.
02:59According to the petition, during a deposition in state court,
03:02Dr. Fowler admitted to not placing a central line in a patient since 2013.
03:07Dr. Irvin Yen, a retired cardiac anesthesiologist who's witnessed 19 executions in Oklahoma,
03:13said he couldn't remember executioners ever having trouble installing an IV,
03:17but wouldn't go so far as calling a failed IV attempt as a botched execution.
03:21Of the 19 that I've witnessed, I don't think they have had trouble with an IV,
03:28and they certainly didn't have to start a central line.
03:31A difficult IV is not unusual.
03:35In my view, it's not a botched surgery or a botched execution.
03:39It's just somebody that has lousy veins,
03:41and apparently that guy in Tennessee must not have had the great, the best veins.
03:47Executions for inmates on death row are also scheduled in Alabama and Oklahoma on August 13th.
03:52According to the Associated Press,
03:53it'll be the first time that three inmates will be put to death on the same day since 2010.
03:58A lot of people will be put to death on the same day since 2010.
03:58A lot of people will be put to death on the same day since 2010.
03:58A lot of people will be put to death on the same day as a day since 2010.
03:59A lot of people are still there.
