00:01The Court of Appeal has unanimously allowed Rosmah Mansour to introduce fresh evidence
00:05in her appeal against her conviction in the RM1.25 billion solar hybrid project corruption case.
00:11A three-member bench comprising Justices Azahari Kamal Ramli, Choo Ka Singh and K. Monyandi
00:16found that Rosmah had satisfied Section 61 of the Courts of Judicature Act 1964
00:21and the Ladd v. Marshall Test.
00:24The Court ordered the new evidence to be taken before a new High Court Judge
00:28within two weeks of case management on September 10th.
00:31Rosmah's appeal hearing has also been rescheduled to October 14th to 16th and October 19th to 23rd.
00:38Justices Choo, who delivered the broad grounds, said the evidence of prosecution witness Rayyan Radzweil Abdullah
00:44would be tested through further cross-examination and re-examination.
00:49Rosmah had sought to rely on a police report, a statutory declaration by Rayyan and supporting documents,
00:55claiming they showed his evidence against her had been compromised by prosecutorial pressure.
01:01Rayyan had also alleged that his statement to investigators was suppressed and produced previously
01:06unavailable WhatsApp communications and other documents.
01:10The court stressed that it was not deciding whether the new evidence was true at this stage,
01:15only whether it was credible and capable of belief.
01:18Choo said the evidence, if accepted, could reasonably create doubt over Rosmah's guilt,
01:23especially given the trial judge's reliance on Rayyan's testimony
01:26and that refusing the application could risk a miscarriage of justice.
01:31Rosmah was convicted in 2022 of soliciting RM187.5 million and receiving RM6.5 million in bribes linked to the
01:39project,
01:39before being sentenced to 10 years jail and fined RM970 million.
