00:02A federal judge ruled that J.M. Smucker can proceed with its trademark lawsuit against Trader Joe's
00:08over frozen peanut butter and jelly sandwiches that Smucker says are too similar to Uncrustables,
00:14according to the Associated Press. Smucker alleges Trader Joe's copied the round shape,
00:20crimped edges, and packaging associated with Uncrustables. Trader Joe's argued its sandwiches
00:24are squircles and that the crimped design is necessary to keep the filling inside.
00:29U.S. District Judge John Adams ruled Friday that Smucker has spent substantial resources
00:34developing and protecting Uncrustables and that customers associate its design trademarks with
00:40the brand. Smucker is seeking restitution and wants Trader Joe's products and packaging destroyed.
