00:20video does not show the shooting itself. Garces Perez's lawyer says he was taken back to the
00:25hospital this week and has since been returned to federal detention. She says he's still in a lot
00:31of pain with the bullet lodged near his spine. On Tuesday, a federal judge ordered him to appear
00:37in person next Wednesday as his attorneys fight his deportation. Garces Perez entered the U.S. in 2024
00:43through the Biden-era CBP-1 program. His lawyer says he was later ordered deported after missing a hearing
00:51because the notice went to an old address. NBC News reports the ICE officer who shot him had been
00:57issued a body camera but wasn't wearing it. Another ICE officer was wearing one, but DHS says
01:03that video doesn't capture the shooting.
