00:36To clarify, before I proceed, Rule 18 does not apply to enrich the records as well and to inform the

00:45Rule 18 did not apply or does not apply to Mayor Duterte when he made his statement,
00:51although the subpoena was already issued,
00:54because at that time he was not yet a witness of this court.
00:59It is only now, after he took his oath, that he became a witness of the court
01:03and therefore Rule 18 applies to him as to the statements he will be making before this court this morning
01:09and this afternoon.
01:12Having set that aside,
01:14court therefore declares that the adverse interest of the witness has been established
01:17and declares him a hostile witness.
01:20Attorney Ted may ask leading questions, but to clarify again, not misleading questions,
01:25and to respect the rights of the accused as contained in Rule 132, Section 3,
01:31in the course of his direct examination,
01:33because that does not give counsel, as you know,
01:36the right to violate the provisions of the rules and the Constitution with respect to a hostile witness.
