00:00The conduct of these men was disgusting, despicable.
00:03A key piece of evidence in the alleged gang rape of a Cornell University student was handed to
00:08police by one of the Chi-5 fraternity brothers themselves at the time of the purported attack,
00:13but nothing was done. I'm talking, of course, about the now viral Snapchat image offering up
00:17an incapacitated female's body to all of the frat brothers for, quote, free. The victim's
00:22attorney confirmed to the Post that this crucial piece of information got into the hands of
00:26investigators because one of the disgusted Chi-5 turned it over. Despite that evidence,
00:30no charges were filed against the so-called Cornell 7, a choice the district attorney
00:34defended to Fox News on Tuesday. The allegations, if accepted as true, did not allege violations of
00:41the penal law. In other words, there's no probable cause to charge these men at that point with crimes.
00:48As for that evidence I mentioned, the Snapchat image, the DA called it, quote,
00:52not relevant to the issue of whether Jane Doe consented to what was happening. Her lawyer
00:57disagrees. She's feeling that Cornell police and the DA failed his client for not holding her alleged
01:02attackers accountable and that the university also has culpability for forcing her to remain on campus
01:07and refusing to refund her tuition so she could transfer. He tells the Post, quote,
01:11had members of the fraternity been interviewed and leads followed up, I believe we would have had
01:16much more detail about what occurred. Now, even though he stands by the earlier choice not to file
01:22charges following mounting public pressure, the district attorney has agreed to open a probe into
01:27the horrific accusations.
