00:01in a legal first the court of appeal has ruled a person in queensland previously acquitted of
00:08murder should face a new trial now legally we can't identify this man but what we can say is
00:15he was arrested in 2023 for the second time charged over the alleged murder of a man in
00:21in 2009 he already faced a trial more than a decade ago but was ultimately found not guilty
00:29earlier this year prosecutors submitted there was fresh and compelling evidence in his case
00:35which included two alleged confessions he'd told police years after his acquittal that he was
00:42involved in the man's death and had gotten away with it and was now a christian and wanted to tell
00:47the truth however his lawyers argued that those admissions were not reliable as they were
00:53inconsistent the court of appeal decided it was in the interests of justice to hold a second trial
01:00this is only the second time the double jeopardy laws have been exercised here in queensland
01:06the first was in 2018 in an unrelated matter which was ultimately dismissed by the court of appeal
