06:40first, and then looking for evidence that simply did not exist.
06:45The Delhi court handed down a verdict that will echo through every corridor of power in the country.
06:51Not just in Rouse Avenue, but in North Block, in Lodhi Road, where the CBI office is actually.
06:58And in every state capital where an opposition government is looking over its shoulder.
07:03Special Judge Jiten Singh discharged all 23 accused in CBI's Delhi excise policy case.
07:13In doing so, he delivered a 598-page judicial demolition of what was once called the biggest corruption scandal in
07:23Delhi's history.
07:24The court's finding was not gentle.
07:27It did not say insufficient evidence.
07:30It said no overarching conspiracy, no criminal intent, no cognant material as well.
07:39Just a theory built on conjecture.
07:43And dressed up in these almost 600-page charge sheet and sold to the country as an ironclad proof of
07:51guilt.
07:53But what makes today's verdict truly unprecedented is not the discharge.
07:58It is what came with it.
08:01In a rare and surgical move, the court ordered the departmental inquiry against CBI's own investigating officer
08:09for lapses, for misleading overtments, for charge sheets riled with internal contradictions as well.
08:15The agency that came to prosecute is today facing its own prosecution.
08:23It's not just a legal story.
08:25This is a story about power.
08:27About who controls the investigating agencies of this republic.
08:31So today, we ask five questions.
08:35Not to the accused whom the court has discharged, but to the accusers.
08:40Today, we have these five questions for CBI.
08:46Number one.
08:47Your own investigating officer faces a departmental inquiry.
08:51So who gave him his orders?
08:54Number two.
08:56A thousand days of jail and not one charge that stuck.
09:01Is that investigation or intimidation?
09:05Number three.
09:07Who ordered this investigation and who benefited from the timing of this investigation?
09:16Number four.
09:18Why do your cases against opposition leaders collapse, but never begin against those who join the BJP?

09:57First up, we'll take you through all those statements that have been made by Aravind Kejriwal as well.

10:14Okay, we are now getting to know that CBI has filed an appeal already in the Delhi High Court challenging
10:20the trial court order.
10:21It's charging former Delhi Chief Minister Aravind Kejriwal and Amadi Party other leaders like Manisha Soria in the liquor policy
10:29corruption case.
10:29That was quick move.
10:31Just hours after the Rouse Avenue court gave them an absolute clean shit.
10:37Now, CBI has already knocked on the doors of the Delhi High Court.
10:42Nalini joins us for more details on this story.
10:45Nalini, this is not just a clean shit.
10:50This is the details of the court order from Rouse Avenue goes on to say that this was a James
10:57Bond style of investigation.
11:00They had no credence and they actually want investigation done against the officers.
11:05On a case like that, what is the basis on which CBI is even taking it to the High Court?
11:12So, Nalini, we were expecting for the CBI to knock the doors of the High Court irrespective of how scathing
11:18the order of the trial court was going to be against them.
11:21But this is the reason, the points that you mentioned is the reason that we've been saying from the beginning
11:25that despite being a big relief for Aravind Kejriwal and the Amadmi Party,
11:30this is a bigger setback for the CBI because of the kind of things that are mentioned in the 600
11:35page order.
11:36Now, it's surprising the alacrity with which the CBI has acted, also keeping in mind the kind of observations that
11:42have been made against them.
11:43It was crucial that they appeal against this order as early as possible.
11:47But remember, it's a 600 page order, but they have gone through that.
11:51We are given to understand from our sources within the CBI that the appeal has been filed before the Delhi
11:55High Court.
11:55But for them to get an urgent hearing is going to be slightly an uphill battle.
12:00Essentially, because for the next entire week, the Delhi High Court is going to be closed for the holy vacations.
12:06And along with that, another battle that we are going to see in the Delhi High Court is when Aravind
12:10Kejriwal and Manish Isodhya move the High Court seeking discharge in the ED case as well.
12:14So we can effectively say that the entire battle has shifted to the Delhi High Court.
12:19The CBI has sought a stay on the trial judge's order.
12:22They've also requested for an urgent hearing.
12:25They've stated that there were several aspects of their investigation in the excise policy case,
12:30which were not appreciated and not taken into consideration by the trial court.
12:35That is the basis on which this appeal has been filed.
12:37But how soon they'll be able to get a hearing from the Delhi High Court is something that remains to
12:41be seen.
12:41All right, so not sure how soon this will be taken up.
12:45But Nalini is right, the battle has clearly moved to the Delhi High Court now.
12:48And let's see where it gets, which judge does it go in front of, which, when and how this case
12:56actually gets picked up.
12:57Meanwhile, the day today, today at least, we don't know what the future of this case is going to hold,
13:03what the future proceedings are going to say.
13:05But tonight, the day is clearly Arvind Kejriwal's and Ahmadi parties, and he ensured that he drives the message home.
13:13He addressed a detailed press conference.
13:15Before that, there was an entire parade of sorts, a victory parade of sorts,
13:20that was carried out in the national capital region.
13:22And the question Arvind Kejriwal has, or the message that he has, is very simple.
13:27He is taking the battle directly to the doorsteps of Narendra Modi, Prime Minister Narendra Modi and Home Minister Amit

13:35saying, I dare you to hold elections today.
13:39Listen.
13:42Arvind Kejriwal is not a judge.
13:48I have only earned a trust in my life.
13:54They have put a case in jail.
13:57And the court has said that Arvind Kejriwal is a trustee.

16:32No words being minced.
16:34And almost the word that really struck with me
16:38is that it's been like this
16:40James Bond kind of investigation that's going on.
16:44That nab these people then find out what's happened
16:46and overall what you see in return
16:48is an unprecedented, actually unprecedented time
16:51when a sitting chief minister stays behind bars.
16:54At a time like this when you are interacting
16:57say with CBI sources
16:58with even BJP for that matter
17:01what exactly are you hearing
17:03beyond the sound bites?
17:04What are you hearing?
17:07Well Sonal, there is no doubt
17:08that this is a major setback
17:10for the Central Bureau of Investigation
17:12as far as CBI officials are concerned.
17:13I spoke to several officials
17:15who were part of this entire investigation
17:18and what they have been saying
17:19that even they were not expecting
17:21that this will be the kind of observation
17:24this will be the kind of order
17:28which will be given by the special CBI code
17:31in connection with this case.
17:32Now as far as CBI is concerned
17:34what they are maintaining
17:35is that several aspects of the case
17:39several aspects of the evidence
17:40which are gathered by the Central Bureau of Investigation
17:43it was not appreciated by the court
17:45it was not considered by the court
17:47and that is why several observations
17:51have been made against
17:52Central Bureau of Investigation
17:54and the entire investigation in the case
17:56and that is why Sonal I can
17:58you know fully, with full confidence
18:01I can say that this is the quickest
18:03the Central Bureau of Investigation
18:05has moved before a high court
18:07in connection with any of the lower court order.
18:11In earlier cases what we have seen
18:12is that there is at least a day or two
18:15which the CBI takes
18:16there is a legal opinion
18:17and then only they approach
18:18the higher court in this case
18:20but here within few hours
18:22CBI has approached the court
18:24because of three main reasons Sonal.
18:27One is the kind of observation.
18:29One of the important observation
18:31of the special court was that
18:33there was a narrative
18:34which the CBI was trying to build.
18:36It is a very serious game
18:38allegation against
18:39the Central Bureau of Investigation.
18:41Yes.
18:41Second, CBI's case was based
18:43on one important fact.
18:46That is the statement given
18:47by the approvers in the case
18:49who became the government
18:50approver in the case.
18:52The court has made a special observation
18:55saying that these approvers
18:57are self-serving.
18:58they want their liberty
19:00and that is why
19:01they give a kind of statement
19:03because of which
19:04they can enjoy the full liberty
19:05but you know the brunt
19:07is faced by someone else.
19:09And third one was
19:10that there was no
19:11corroboratory evidence
19:12against Arvind Kejriwal,
19:14Manisi Saudia,
19:15and in one case
19:16the Deputy Excise Commissioner
19:18Kuldeep Singh.
19:19The court said,
19:20I don't know why
19:22he has been made accused
19:23in the case.
19:24These are very serious
19:26and grave allegations
19:27by the court
19:28against the Central Bureau
19:29of Investigation
19:30and that is why
19:31not only the discharge
19:33of these 23 accused
19:34but also to make things right,
19:37make things correct.
19:38The CBI has moved
19:39before the court,
19:40before the high court
19:41on the grounds
19:42that there is
19:43enough material
19:44based on which
19:46these 23 accused
19:47were named
19:48as accused
19:49in the charge sheet.
19:50The court also decided
19:51to frame charges
19:52against them.
19:53But when it came to
19:54taking cognizance
19:55of that particular charge sheet
19:57or moving ahead
19:58with the trial
19:59in this case,
20:00the court decided
20:01to discharge
20:02all these accused.
20:02So it will be very interesting
20:03what happens
20:05in the high court.
20:06What you are saying, Munish,
20:06is very very interesting
20:07and let me take that
20:08to Aashwarya.
20:09Now Aashwarya,
20:09you heard Munish over there,
20:10he is saying,
20:11never in the history

20:13such a quick
20:14sort of, you know,
20:17case being taken
20:17to the higher court.
20:18That tells you one thing,
20:20that there is no
20:20fresh evidence
20:21that they are banking on.

20:23the same stuff
20:24to the high court
20:25in hope that they
20:26will get another order.
20:28Right?
20:29What exactly is happening
20:30within the doors
20:32of the BJP?
20:32We have had one or two
20:33reactions from the party,
20:35not a lot on this front.
20:37But what are you hearing?
20:39Are they, I mean,
20:41on one hand Arvind Kejriwal
20:42is crying tears of joy
20:43or tears of finally
20:45being vindicated
20:46in this case.
20:46What's the sentiment
20:47like inside the BJP office?
20:53Well, Sonal, let me tell you,
20:54you know, the one word
20:55that we saw coming out
20:56from the BJP was that
20:57there will be a structured
20:58response from the BJP,
21:00from the Bharti Janta Party,
21:01and that is exactly
21:02what you should also
21:03be expecting,
21:04because the BJP also
21:05has gone back
21:06to the drawing board.
21:07They are also looking
21:08at the order,
21:09reading the order
21:09very carefully,
21:10and then they will have
21:11a response with regards
21:12to what exactly
21:13has happened.
21:14But let me tell you,
21:15they still very firmly
21:16believe that there is
21:17evidence on the basis
21:18of which court
21:19in the first place
21:20had said that,
21:21yes, you can go ahead
21:22and you can do investigation
21:23in this case.
21:24So this is what
21:25the BJP leaders
21:26have been speaking about,
21:27pointing towards
21:28the very same evidence
21:29as you also rightly
21:30pointed out,
21:30and as Munish was also speaking,
21:32that they are now
21:32knocking on the doors
21:33of the High Court.
21:35So the BJP believes
21:36that this is something
21:37which is being fought
21:37in the court,
21:38so we need to wait
21:39for the final verdict
21:40to come out.
21:40But yes, they still believe
21:42that there is some evidence
21:43that the agencies have
21:44on the basis of which
21:46they believe that
21:46there will be an order
21:47which will point
21:48towards the fact
21:49that the lapses
21:50were being done.
21:51But yes, this has become
21:52a big political fight.
21:53BJP also very closely
21:54and keenly watching
21:55with a hawk's eye
21:56on what exactly
21:57the court will do next.

25:18And generally,
25:19going by precedent,
25:21and perhaps,
25:22you know,
25:22with your experience,
25:23does it happen that such a scathing,
25:25one-sided judgment,
25:27when I say one-sided,
25:28I mean,
25:28very clear in the way it's going.
25:31Is it,
25:31has it happened in the past,
25:33that High Court has completely taken a U-turn on it,
25:36and come out with a different verdict at all?
25:38What does history tell us here?
25:41Well,
25:41someone who has followed this case since the beginning,
25:45since Manish Asodia's arrest,
25:47and we've seen them being brought to court after that,
25:49and whatever has followed since then.
25:51There's one thing that I would like to point out.
25:53One word that we've seen very closely associated with Delhi excise policy
25:57that was brought by the Ahmadinei Party government,
25:59was a scam.
26:00The Delhi excise policy scam is the word that we hear.
26:03Now,
26:03the court today has put a big question mark on that.
26:05Was there a scam in the first place?
26:08Because according to court,
26:09there is no evidence to show that the Delhi excise policy was manipulated,
26:12or altered or engineered for any unlawful benefit to absolutely any individual.
26:18Not just that,
26:18we've also seen the court back,
26:20Ahmadinei Party's Delhi excise policy in a way,
26:23by saying that the policy was an outcome of consultative and deliberative exercise,
26:28which was undertaken properly by those who were involved in the formulation and the execution.
26:34Now,
26:34after this,
26:35after the observations that have come in,
26:37of course,
26:37it was expected that the CBI would not sit idle and the CBI would challenge it before the Delhi High
26:43Court,
26:44because not only would they want to challenge the main decision where accused in their case have been discharged,
26:51but also the fact that serious questions have been raised on CBI's investigation by the court today.
26:57Now,
26:57that's exactly that has happened.
26:59If we talk about the precedence here,
27:01Sonal,
27:01when we talk about cases where bail has been granted or accused have been discharged,
27:06it is very rare for courts to interfere and reverse that judgment.
27:10But of course,
27:11it is a possibility.
27:12If the Delhi High Court believes that the judgment was not fair,
27:16it can in the interim state and then continue to hear arguments on it before it pronounces its final decision.
27:24Like I said,
27:24yes,
27:25but it can happen.
27:26Even CBI can get a favourable order.
27:28But on the other side,
27:29we know that even in the enforcement directorate's money laundering case associated with the excise policy,
27:34the Ahmadi party and its leaders are all set to move the Delhi court seeking a discharge relying on today's
27:42order,
27:43today's favourable order which has come in their favour.
27:45Got it.
27:46So very rare does it happen that a Delhi High Court will,
27:50you know,
27:50completely reverse or overturn the verdict from a court,

28:33But in the view of the Rouse Avenue court,
28:35the foundation of the claim simply does not stand.
28:39Here's what the court said,
28:40and on the policy itself.
28:43Point number one,
28:44there is no evidence that Delhi liquor policy was manipulated.
28:48Number two,
28:48it says,
28:49there is no material to show that the policy was engineered
28:52to favour any one individual or group.
28:57Number three,
28:58it says,
28:58the court has found no proof of any alterations made for unlawful gain.
29:04Number four,
29:05these are all court.
29:08You know,
29:09verdict that has gone down in that 600-page verdict of the Rouse Avenue court.
29:14Number four,
29:14it says,
29:15it has observed that the entire process of drafting the policy was consultative and deliberative in nature.
29:22And finally,
29:23number five,
29:23it says,
29:24as probably the most crucial one,
29:25the court has clearly stated that the excise policy was framed in accordance with law.
29:33In a sense,
29:34what investigative agencies described as a scam,
29:37the court has found no evidence to substantiate it.
29:43All right.
29:44And then,
29:44of course,
29:45like I said,
29:46this has led to massive reactions coming out from the Ahmadi party.
29:49Leaders that we had not seen for several months now,
29:53even years for some matter,
29:54they all came out to speak.
29:55We had some exclusive chat.
29:58India Today's Preeti Chaudhary spoke with the former Delhi Deputy Chief Minister Manish Sisodia,

30:07was this case the reason why you lost the Delhi election?

31:08wife on if they thought this was the reason why they lost the Delhi election.
31:14One could argue there were several others, Shish Mahal being one of them.
31:18But today, when you speak to so many Ahmadi party leaders, what is the sense?
31:23Is this like this comeback, jago moment for Ahmadi party?
31:28Is this the ammunition they needed to get into the Punjab elections?
31:33Well, Sonal, you know, this is a moment of reckoning for the Ahmadi party because they did not
31:38expect this.
31:38What was really expected?
31:40And I do know because today they all thought charges would be framed.
31:43And then it's a matter of time and the court, you know, to hear the case and then it would
31:48be decided.
31:49They were all caught off guard.
31:51Because I remember in the morning when I was having a conversation with some of my sources,
31:55they were saying they were trying to actually formulate what would be the difference if
32:00the Rouse Avenue court frames charges.
32:01So they were all caught off guard.
32:03None of them really expected, you know, a verdict like this.
32:07And verdict so strong, especially where it directly indicts an investigative body.
32:13Number one.
32:14Was it something that, you know, is it something that they needed?
32:19Of course, because they've had their back towards the wall, especially in the last couple of years.
32:23This was the sheer premise on which Arvind Kejriwal was, you know, went to jail.
32:29This was the reason why the top brass of his party, all five leaders went to jail, where
32:34he had to step down and an artishi needed to step in.
32:37This was a time where, if you remember, many of his MLAs had left and joined the BJP.
32:42So his party practically disintegrated.
32:44Of course, there is a sense within the party that it was this very reason of, you know,
32:51the case which was, as per them, a fake case that was spun around on the back of which they
32:56lost the Delhi election.
32:58And this is what is their biggest, you know, war cry now?
33:03Hold elections.
33:04Of course, it's not possible, but they are going to town and saying hold elections today
33:07and you will see a different result.
33:09Because two years down the line, it was inception where the voters of Delhi were concerned.
33:13You convinced them that we were corrupt, but we weren't.
33:16This is what they're going to take to Punjab.
33:18They have an election in 2027.
33:20And importantly, they are fighting the BJP, you know, head on in Gujarat.
33:25And they're also fighting against the Congress in Gujarat and in Goa.
33:29They are hoping this bolsters their image.
33:32But look at the nuance in it.
33:34While all the other opposition parties have come and spoken up.
33:38The Congress hasn't, yeah.
33:39Yes, the Congress hasn't.
33:41And, you know, the reason why the Congress hasn't is because the Congress has to fight
33:45the Ahmadineh party, not just in Punjab, in Goa and in Gujarat.
33:51And the nuance is also that their lawyer happens to be one from the Congress party as well.
33:56So many, you know, wonderful anecdotes coming out from this party and from this entire fiasco as well.
