Datuk Seri Ismail Sabri Yaakob’s defence has described the charge against the former prime minister as “peculiar”, saying it involved a similar subject matter dealt with under a separate provision of the Malaysian Anti-Corruption Commission (MACC) Act previously.

His lawyer, Datuk Amer Hamzah Arshad, said the defence would study the charge and raise certain concerns over its propriety and legality.

00:06This morning, Datuk Isramay El-Sabi attended court, he was charged under section 36 of the
00:14MSC Act. Essentially, it is an offense of not complying with the notice to declare certain
00:20assets. And today, myself, together with Datuk Isri Rajan, together with Mr. Ragunaskar Servant, we appeared
00:29for Datuk Ismail. Initially, the prosecution proposed the bill sum of 500,000. They wanted
00:36his passport to be surrendered to the court. Of course, we objected to the amount being too excessive,
00:44manifestly excessive, and with regard to the condition punitive. It is punitive in nature,
00:50and with regard to the passport, we objected for the passport to be surrendered. There is no necessity
00:56for his passport to be surrendered. He has proven himself to be not a flight risk. There is no
01:02evidence to show that he is a flight risk. He is here to clear his name. And upon hearing the
01:09arguments
01:09that Datuk Isri Rajan had taken forward, myself and Mr. Ragun, finally, the court had decided that
01:14the appropriate bill amount could be set to 300,000, and the court decided not to impound his passport.
01:23So, that is as far as what happened in court today. The date had been fixed for case management for
01:29the prosecution to supply all the relevant papers which they need to use in court. That's it. Anything else?
01:36Yes. What's the date? What's the date? I mean, it's 29 September. 29 September. For the prosecution to
01:44handle all the documents. In the meantime, we will be studying the charge, and of course, I mean,
01:50I will be informed the court that we are raising certain concerns about the propriety and the legality
01:55of the charge. But we're not going into detail. We will definitely do something with every study of the
02:01charge, and if they need to be able to be filed, that's the application.
02:04And, uh, you said that, uh, there may be, uh, something that you said that the case is
02:11quickly, uh, because of why? Oh, yeah. We're saying that, uh, prior to this, there was an application
02:17for the prosecution, uh, through MECC, uh, for those assets that have been the subject matter of the
02:25current charge to be forfitted. The normal circumstances, when you use that particular provision,
02:31we have decided that there shouldn't be any prosecution. So, and there was an information
02:37government by the prosecution that was studying the IP that decided not to take any action.
02:42And the fact that suddenly now, there is a change of heart by the prosecution, that's something that
02:48we have to look into. That's why we say it's been possible. It is never, never, this situation has never
02:55reason. Okay, uh, Alhamdulillah is recovering. I mean, he's due for his next visit, uh, with IGN as a
03:06follow-up. So, as far as today, of course, we're glad that nothing, uh, uncoats happened to him,
03:11and let's keep, let's keep on waiting for his, uh, help. How does he feel about this charge?
03:16Nobody likes to be charged. Let us be clear on that. I mean, especially when you think that the charge
03:20is
03:22faceless, faceless, unfounded, and after what had transpired based on the circumstances of the
03:27pornography, of course, nobody would be happy about it. Nobody's going to be happy. Assuming that
03:32the current communist, assuming that he steps down, he wouldn't like to be charged as well.
