00:47We begin this morning with a remarkable rescue in Nepal.
00:50Two workers pulled alive from a hydropower tunnel nine days after catastrophic flooding trapped them underground.
00:57Nepal's army says the two men, a mechanical foreman and supervisor, were rescued from the Trishuli 3A hydropower plant.
01:05Both were in stable condition, but were flown to a hospital in Kathmandu for treatment.
01:11Rescuers first heard voices from inside the tunnel Friday morning confirming there were survivors and helping them locate the men.
01:18And they say more voices can still be heard.
01:22At the Trishuli plant alone, hundreds of workers remain missing, with more than 100 believed to be trapped in the
01:28main tunnel.
01:29Across Nepal's hydropower projects, about 900 workers are still unaccounted for.
01:35Officials say they're hopeful more people can be rescued.
01:38Nationwide, more than 1,200 people have been killed in the floods, with thousands still missing.
01:43Across the border in Tibet, Chinese officials say 21 people were killed and more than 500 remain missing.
01:51Deadlocked jurors in the Lindsay Clancy trial will be back behind closed doors this morning for a seventh day of
01:56deliberations.
01:57And after more than 30 hours without a verdict, Thursday brought a new problem inside the jury room.
02:03The judge received a note from the jury foreperson and then called each of the 12 jurors to the bench
02:09individually.
02:10After speaking with them, Judge William Sullivan reminded the entire jury that they are required to follow his instructions on
02:17the law.
02:18He then read them the definition of reasonable doubt again and sent them back to deliberate.
02:24Clancy's attorney, Kevin Reddington, objected.
02:27He said the foreperson's note indicated one juror was refusing to follow the judge's instructions and asked Sullivan to remove
02:34that juror.
02:35The court has an instruction from the foreperson of that juror that's been working for a week now saying that
02:42there's one juror who refuses to listen to the law that you've given him or her on reasonable doubt.
02:49Sullivan refused, saying he couldn't side with one juror or the other 11 without knowing what was happening inside the
02:56deliberation room.
02:58Reddington warned that could leave the case headed for a mistrial.
03:01And if we come back here in a half an hour with a mistrial because of a because of a
03:06juror that has just spurned the instructions of this court, it's a shame.
03:11It's a real shame.
03:12And that's why I object to the court's ruling.
03:15I request that we have further inquiry.
03:18I request that my motion is to remove this juror that refuses to listen to your instruction on reasonable doubt.
03:24The jury deliberated for about another half hour before being sent home.
03:28They've already told the judge twice that they're deadlocked.
03:31Clancy doesn't deny killing her three young children in 2023.
03:35Her attorneys say she was suffering from postpartum psychosis and is not criminally responsible.
03:41Prosecutors say she planned the killings and knew right from wrong.
03:45The jury is back at it at nine o'clock this morning.
03:49For the first time, a federal immigration officer is facing charges from the Trump administration over his actions during the
03:55massive immigration crackdown in Minnesota.
03:57According to the Associated Press, ICE officer Christian Castro is accused of lying to federal investigators about a shooting in
04:05Minneapolis back in January.
04:07Castro shot Julio Cesar Sosa-Seles in the leg during an immigration operation.
04:12Federal authorities initially said Sosa-Seles and another man attacked an officer with a broom handle and a snow shovel.
04:19But prosecutors later dropped the charges against both men after video evidence raised questions about the officer's account.
04:27And if you're watching us this morning, here's some of that video.
04:30It shows an immigration agent chasing a man toward a home, followed by a brief struggle on the ground.
04:35Two people then run inside.
04:38Minnesota prosecutors say Castro later fired through the front door, hitting Sosa-Seles in the thigh.
04:43Castro is now accused of making false statements to the FBI about what happened.
04:47The federal case is separate from assault and false reporting charges Castro already faces in Minnesota.
04:53And a federal investigation into whether he should face a more serious civil rights charge is still open.
04:59Castro was released from this jail in Texas last week after Minnesota's attempt to have him extradited was blocked.
05:05He was suspended from ICE without pay in February.
05:09An attorney for Sosa-Seles says the false statement charge doesn't go far enough.
05:13He's calling for civil rights charges as well.
05:16Vice President J.D. Vance says he wouldn't call the U.S. conflict with Iran a war and he won't
05:21say when the fighting could end.
05:23Vance made the comments Thursday during his first appearance at a White House press briefing.
05:28Asked how much longer the conflict could last, Vance rejected the word war.
05:32I wouldn't call it a war. Right now there is no active shooting.
05:36I recognize there have been places where this has flared up.
05:40Major combat operations, again, major combat operations lasted for about six weeks.
05:45And since then, we destroyed, of course, their nuclear facilities with Midnight Hammer.
05:50With Epic Fury, we destroyed their defense industrial base for producing weapons and also a lot of their conventional military.
05:57And then we made it harder for them to rebuild that nuclear program.
06:00But when you ask, when will this end, you're asking me a question like, when will the Iranians stop shooting
06:07at ships?
06:08I think the reality is, I don't know the answer to that question.
06:10You would have to ask the Iranians.
06:12Vance was also asked about Iran's claim that a U.S. strike this week hit a wedding party, killing four
06:17civilians and wounding dozens more.
06:19He says he's extremely skeptical of that account.
06:23The U.S. military says it's investigating and that it does not target civilians.
06:28And the economic impact of the fighting continues to grow.
06:31The national average for diesel hit an all-time high this morning, $5.85 a gallon.
06:37That's up 17 cents in just two days, as the Iran war disrupts global energy markets and shipping through the
06:43Strait of Hormuz.
06:45The Trump administration is asking the Supreme Court to let new Postal Service rules for mail-in ballots take effect
06:50before the midterms.
06:52A federal judge temporarily blocked the rules last week.
06:55At issue are new requirements for ballots being mailed to voters.
06:59States and local election offices would have to use new envelope designs and unique barcodes
07:05and submit voters' names and addresses through an online Postal Service portal.
07:09The Justice Department says the Postal Service is regulating the mail, not taking over state elections, and calls the requirements
07:17modest.
07:18But Democratic-led states and voting rights groups say the rules intrude on state-run elections and could disenfranchise voters.
07:25The judge temporarily sided with them, with ballots already printed in some places and too little time, she says, for
07:32states to make the required changes.
07:34North Carolina starts mailing ballots today.
07:37The states have until Tuesday morning to respond to the administration's Supreme Court appeal.
07:42Finally this morning, President Trump is moving forward with plans for his massive triumphal arch, even as a lawsuit tries
07:49to stop it.
07:50Interior Secretary Doug Burgum said Thursday that excavation work at the plant site will begin in the next two weeks.
07:56It's between Arlington National Cemetery and the Lincoln Memorial.
08:00The 250-foot arch proposed by President Trump has received final approval from the U.S. Commission of Fine Arts,
08:06whose members were all appointed by Trump.
08:09But the project still needs final approval from another federal planning commission, and a lawsuit challenging the arch is still
08:15pending in federal court.
08:17The group behind that lawsuit argues the administration needs congressional approval to build it.
08:22The National Park Service says work could take two to three years, with crews working 20 hours a day, year
08:28-round.
08:29That timeline could have the arch finished near the end of Trump's second term.
