03:24to contact the juror at the home where his landlord is currently trying to evict him we're not revealing
03:29his identity because he hasn't chosen to speak publicly and because the juror list is currently
03:34impounded but we wanted to share the details we learned that experts say should have raised red
03:39flags about how he filled out his juror questionnaire okay sir do you have any issue complying with the
03:45order that you stay away from and have no contact directly or indirectly with the alleged victim in
03:49this case and also that you not abuse this person you're listening to audio the mbc10 investigators
03:54obtained from brockton district court in september 2021 that's when the holdout juror in the lindsey
04:00clancy case faced a criminal charge for assaulting his wife according to this police report the juror's
04:0613 year old nephew called 911 after seeing his uncle grab his wife by the throat and throw her into
04:11a
04:11dresser the report says the juror's mom repeatedly screamed your evil as police arrested him court records
04:18show the couple divorced after the incident and the criminal charge was eventually dismissed the ex-wife
04:23told me this week she didn't want to testify in the case because she was worried about losing custody
04:28of her daughter last year that same teenage nephew took out this restraining order after he says
04:34the juror pushed him to the ground and repeatedly punched him in the face the teen wrote that his
04:39uncle then said you ruined my life for calling the police and added you've had this coming your way
04:44for a long time officer said observed that the nephew had injuries to his left eye and his clothes were
04:52ripped that restraining order was still active when the juror was selected for the lindsey clancy trial
04:57and listened to evidence for weeks in the high profile case i don't see how they would have allowed him

05:03be a member of this jury nbc 10's chief legal analyst michael coin is talking about this confidential
05:09juror questionnaire which clearly asks if someone has been arrested been charged with a crime or been
05:14served with a court order all boxes that should have been checked if those had all been answered
05:20truthfully do you find it hard to believe that he would have been seated on this jury i don't see

05:32he with uh allowing him to be seated the nbc 10 investigators also learned the juror hasn't paid
05:38the monthly rent at his plymouth county home since last march according to housing court records as
05:43jurors deliberated last week the landlord secured a judgment of more than twelve thousand dollars in
05:49unpaid rent and is moving forward with an eviction and i'm going to declare a mistrial when the clancy
05:54trial ended with no verdict several jurors told us how the loan holdout refused to engage in deliberations he
06:00would not interact with us he was very arrogant he really did not take anything that anybody said
06:09when the mbc 10 investigators contacted the jurors family members they said he'd been estranged since
06:15the alleged incident with his nephew none of them knew of his involvement with the clancy trial one
06:20described him as a narcissist who she believes should have never served as a juror in such an important
06:25case what should happen next is the should the court be reviewing that that questionnaire and
06:30seeing how it was answered no doubt that the questionnaire will have to be reviewed and
06:34the district attorney will look at both the questionnaire and the answers and look at the
06:39information to see whether that was truthful it is in fact a crime not to do so we reached out

06:45the plymouth county da's office along with lindsey clancy's defense team so far both sides are declining
06:50to comment juror questionnaires are not public records so it's unclear if the document in question
06:55still exists or if it was destroyed in the wake of the mistrial um since when have you guys heard
