The Supreme Court registry has flagged 14 defects in the INDIA bloc's petition filed against the Election Commission of India, delaying its listing. The identified flaws include missing vakalatnamas or signed lawyer authorisations for 9 out of 11 petitioners, including Akhilesh Yadav, Tejashwi Yadav, and Sanjay Raut. The registry also pointed out an illegible identity copy of Congress President Mallikarjun Kharge, an incomplete court fee short by 220 rupees, and missing supporting records. Furthermore, the registry questioned why individual election commissioners were named alongside the Election Commission as an institution. The top court has asked for digital copies of the June 24 Election Commission decision and records concerning claimed voter deletions on a pen drive. The legal team representing the opposition alliance must rectify all flagged procedural defects before the petition can be formally cleared and scheduled for a hearing before the judges.

00:00And we're getting some breaking news. This is regarding the India Bloc's petition that was filed in the Supreme Court
00:06yesterday against the Election Commission.
00:07Now the Supreme Court registry has flagged 14 flaws in this petition by the India Bloc, which is yet to
00:14be listed because it has not been cleared.
00:17So the flaws include that individual election commissioners have been named in petition in addition to the Election Commission as
00:24a whole.
00:24A clear legible copy of Malik Arjun Kharge's ID is also missing.
00:30The court fee is also short by Rs. 220. The documents on which petition is based is also missing.
00:37Signatures of nine petitioners is also missing from this petition.
00:41The Supreme Court has sought soft copies of June 24 Election Commission decision.
00:46And it is also seeking documents regarding the SIR deletions which are being claimed by the opposition in the plea
00:53in the top court.
00:54So these are the flaws that have been flagged. In total, there are 14 flaws that have been flagged by
01:00the Supreme Court.
01:01My colleague Anisha Mathur is now joining us with more details on this.
01:05Anisha, tell us more about these 14 flaws that have been flagged by the Supreme Court registry and what will
01:10be the way further.
01:12Well, see Anjali, this is a process that happens no matter who files a petition before the Supreme Court.
01:18The registry looks at the paperwork, whether the photocopies that have been filed are clean and legible, whether all the
01:24documentation is in place or not.
01:26That is where these defects have been flagged by the Supreme Court registry.
01:31We saw the huge uproar yesterday where all the India Bloc leaders, along with their supporters, protesters, marched to the
01:39Supreme Court.
01:40However, since they reached the filing counter of the Supreme Court after technically the counter was closed,
01:48their petition was filed by their legal team just before the filing counter was to close at 4.30.
01:56Now, on that basis, some of these errors have come up that the Vakalat Namahs, which is the signed authorization
02:02by the petitioner to the lawyer to file that petition,
02:05is missing for 9 out of the 11 petitioners.
02:08They're also questioning why individual persons have been named in a writ petition, which is against the Election Commission as
02:16a whole.
02:17So we'll find out in the course of today by when the lawyer legal team will rectify these complaints, these
02:24defects.
02:24Because remember, and I repeat for our viewers again, this is a procedure that happened with every file that goes
02:30to the Supreme Court.
02:31There is an entire registry staff that looks at every single piece of paper that is filed to see everything
02:38is correctly filed or not.
02:41But if you look at what is in the petition itself, what is the petition flagged?
02:44They are saying that there was unilateral decision making in the Election Commission, that CEC Gyanesh Kumar did not listen
02:52to the other two election commissioners,
02:55which is violative of the Election Commission Act.
02:57They are questioning the process of deletions.
03:00And more importantly, they're asking for clarification on how any rectification is done if somebody's name is deleted.
03:07But they do have the documentation because there have been concerns raised regarding adding back of names into the SIR
03:18roles after appeals are filed, after all the documentation is shown.
03:23So they are asking for the audit of ERO net, of the ECI net, of how the decision making was
03:28done and how the procedures are working.
03:31So we'll find out in the course of today when that matter is likely to be heard.
03:35Because remember, on 5th of October, there was another PIL on the same lines after the Indian Express reportage regarding
03:44the decision making in the Election Commission.
03:47Notices have already been issued by the Supreme Court on that petition.
03:52That petition is set to be heard on the 27th of October.
03:54Now whether the opposition leader, the India Bloc leader's petition will be tagged with that older petition remains to be
04:01seen.
04:02Whether this will be heard separately and then notices will be issued again and then both petitions will be heard
04:09together.
04:09That is also something we can only speculate about at this moment.
04:13But we can tell our viewers that these questions of the functioning of the Election Commission is already before the
04:19Supreme Court.
04:20The bench has already asked for the file notings, the documents, the minutes of the meetings, etc.
04:27To decide on whether the Election Commission has taken its decision according to the law or not.
04:33But with the spectacle that we saw on the streets and again inside the Supreme Court premises yesterday,
04:39it seems that the India Bloc leaders also want to show that they are also raising these very same issues.
04:46Now it is for their legal team to rectify the defects and then get that matter listed for hearing.
04:52Because till the defects are cured, petitions cannot be placed before the judges.
04:57Back to you.
04:57Alright Anisha, do stay with us.
04:59So there are 14 defects that have been flagged by the Supreme Court Registry.
05:02It is important to note that until these defects are rectified by the India Bloc,
05:07the petition cannot be cleared and hence it cannot be listed for hearing.
05:11Let's take a look at these blunders that have been flagged by the Supreme Court Registry,
05:15which has now flagged 14 flaws in the petition and it is yet to clear the India Bloc's plea.
05:21Now the Supreme Court Registry asks why individual Election Commissioners have been named.
05:26Now it is important to note that in the petition, the Election Commission as a whole has also been named.
05:31Along with the Election Commission, the three Election Commissioners have been named.
05:34So what the Supreme Court Registry is asking is why have individual Election Commissioners also been named in this writ
05:41petition.
05:42Now clear, legible copy of Congress Chief Malik Arjun Kargay's identity card is missing in this petition.
05:49The lawyer authorization is also missing for nine of the 11 petitioners.
05:54Vakalat Nama is unsigned by nine, including Achilles Yadav, Tejashvi Yadav and also Sanjay Raut.
06:00And the clear copies of supporting records is also incomplete.
06:05The Supreme Court Registry has also sought digital copies of Election Commission's June 24 decision.
06:11In fact, it has also sought the SIR voter deletion records on a pen drive by the India Bloc.
06:17The court fee filed by the petitioners is also short by 220 rupees.
06:22So these are the defects in the petition by the India Bloc that need to be rectified
06:27and only then will it be cleared and will be listed for hearing in the top court.
