A federal judge said he would issue a ruling on Oct 28 on the US Justice Department's emergency request to block California from counting mail ballots for the Nov 3 midterm elections cast by some 20,000 alleged non-citizens.

US District Judge David Carter informed lawyers from both sides of his timeline at the end of a three-hour court hearing in Los Angeles on Oct 27.

00:00I think there's a lot of interest in this case.
00:01I think this case is really on the forefront of the administration's battle to fight for election integrity.
00:51American voters are being disenfranchised in real time.
00:54Every minute that goes by, LA County and every other county in California is processing ballots of potential noncitizens.
01:02We've given a list of 20,000 potential noncitizens to California.
01:05They're disinterested in getting to the bottom of this and protecting the American voters.
01:10We've made our case in court today.
01:13I suspect this is going to go quickly back up on appeal.
01:15And so we're committed to fighting for the American people to protect their right to vote and to prevent it
01:22from being diluted by noncitizens.
01:24This is the first case in California we've brought at this scale where we're alleging thousands, tens of thousands of
01:31potential nonvoters are on the voter rolls,
01:34are getting ballots and are currently voting.
01:37And that's going to have an impact on the election in the midterms.
01:40A lot of elections are decided by just a few votes, tens of votes or a couple hundred votes.
01:45So, yeah, this is a big deal.
01:48And so this is the first kind of a test case where we've brought substantial evidence and 20,000 is
01:54the floor.
01:54It's not the ceiling.
01:56We could resolve this whole thing in like a day if California cooperated and wanted to work with us to
02:01check the citizenship status.
02:03We could be done with this.
02:03It needs to be resolved now before the votes are counted.
02:06I understand their point is we could still prosecute people after the election.
02:10But, you know, our goal here is not to prosecute tens of thousands of people.
02:14It's to safeguard the integrity of the election so it doesn't have an effect on the upcoming election.
02:19We want to stop the illegal voting.
02:21We want to we don't want to chase it later.
02:23Same thing with fraud.
02:24You know, we're doing all this stuff to prevent fraud because we don't want to chase after fraudsters.
02:28We want the fraudsters to not get the money in the first place.
02:30I think the last thing that Judge Carter said at the end of this hearing today is really important to
02:37remember.
02:38He said it would be wise that any threats to prosecute state and local election officials cease immediately.
02:48State and local election officials are experts in running elections.
02:52They are doing their jobs under incredible threat from the federal government and under threat of prosecution.
03:01And Judge Carter admonished the federal government to stop those threats.
03:05I think that's very important for everyone to remember.
03:08And it's important that voters remember that these threats need to stop and that they can exercise their right to
03:13vote.
03:14Well, certainly we'll wait to see what the court's order is.
03:18He promised to issue an order by tomorrow and we'll review that in full.
03:23I think the court made a couple of important points at the very end.
03:26He acknowledged that what the federal government is asking would be a monumental change to the way that L.A.
03:34County and the state administer their elections.
03:37Dear students
