00:02A second trial is now taking shape for Lindsay Clancy, the Massachusetts mother accused of
00:07murdering her three young children. Prosecutors say they intend to retry her, but haven't
00:12decided whether to pursue first degree murder charges again. Clancy was back in court Monday,
00:18two months after her first trial ended with a hung jury. 11 jurors favored acquittal,
00:23just one voted to convict. Her attorneys argue she was suffering from postpartum psychosis and
00:29was not criminally responsible for the children's death. Prosecutors say she knew what she was doing
00:34was wrong. At Monday's hearing, prosecutors also asked the judge to limit what attorneys can say
00:39publicly about the case, arguing that comments from the defense could influence a future jury.
00:45But things got heated when Clancy's lead attorney, Kevin Redington, began questioning the conduct of
00:50one juror who voted to convict. Judge William Sullivan interrupted him after he identified
00:55that juror by name. You don't bring your background into a jury room and suppress it as was done in
01:05this case. This gentleman, Mr. Duronsville. I'm going to stop you. No, you're not going to stop me.
01:11I am. No, you're not. All right, then this hearing is no, because there's no need to bring out that
01:18jury's name. It's been all over the internet. That's through the internet. That's through other people.
01:23There's no need here in this court. The judge didn't rule on the requests Monday. He's considering
01:30a retrial as early as March, with another hearing set for November 16th. The defense is also asking
01:35him to dismiss the charges entirely, arguing that a second trial would violate double jeopardy protections.
01:41Yeah.
