00:00 Bank Negara Malaysia has turned to the Court of Appeal to set aside a High Court ruling
00:06 finding it liable in dismissing a former manager on allegations of misconduct following her
00:12 involvement in political activities seven years ago.
00:15 Lawyer Janice Leo said the bank filed its notice of appeal at the High Court Registry
00:19 today.
00:21 Its legal team will also write to the High Court to obtain the grounds of judgment while
00:25 preparing to file the record of appeal.
00:28 On March 29th, Justice Ahmad Bache said why Kohila, 48, was deprived of the right to be
00:34 heard during both the domestic inquiry and subsequent appeal process, constituting a
00:38 breach of natural justice.
00:41 In determining that B&M was liable, he allowed Kohila's declaration that her dismissal as
00:45 an employee was in breach of her employment contract.
00:50 Last week, Ahmad ordered the bank to pay Kohila Rp. 366,000 in damages after a proceeding
00:56 on assessment of damages and another Rp. 50,000 in costs.
01:00 Kohila was said to have canvassed support for Party Socialist Malaysia and its leaders
01:04 in the 13th General Election and was also accused of conducting herself in a manner
01:09 not befitting her status as a B&M employee by participating in a public rally and wearing
01:14 an anti-GST shirt.
