CABRERA CITES ₱817.87M IN ALLEGED UNDECLARED ASSETS; PROSECUTION, DEFENSE CLASH OVER RECORDS

#VPSaraOnTrial Day 37 RECAP: House prosecutor Rep. Chel Diokno shared a report from forensic financial analyst Atty. Alexander Cabrera. The report claimed that Vice President Sara Duterte and her husband, Atty. Manases “Mans” Carpio, had ₱817.87 million in alleged undeclared income and assets from 2022 to 2025. It raised doubts about the accuracy of Duterte’s Statements of Assets, Liabilities and Net Worth (SALNs), pointing to significant assets that were supposedly not declared and her ongoing involvement in businesses while serving as vice president. The findings were based on a limited set of documents and did not include records held by Duterte and Carpio.

The presentation sparked exchanges between the prosecution and defense over whether financial records should remain confidential and whether the report’s findings should be called "alleged" before Cabrera was cross-examined. Defense counsel Sheila Sison said the trial should focus on facts, not rhetoric, while defense lawyer Kristine Ferrer questioned the use of the term “prima facie fraud.” Senator-judge Raffy Tulfo also asked why Duterte and Carpio’s legal team did not address the Constitution’s rules on the vice president holding another job. Presiding Officer Chiz Escudero also joked about the BIR’s tax collection during the witness questioning.

00:00For the BIR, Your Honor, only there is a transfer, there is a tax.
00:04You are always like that.
00:07What I would like to say here is that B.P. Sarad,
00:11because they have stolen it.
00:14They didn't have it inlayo.
00:18Like what's happening now,
00:21they have stolen it.
00:23Are we having a tutorial on what the tax form contains, Your Honor?
00:28Actually, I'm learning, Attorney Irwin.
00:33But yes, Attorney Christine, you're going to a point, right?
00:37Prima faci fraud, in Tagalog,
00:40in the first opinion, there is a fraud or a fraud.
00:44Objection, Your Honor.
00:47I'm just translating it.
00:49What's the objection, Attorney Christine?
00:50We would like to propose, Your Honor,
00:52that the exact wording of the law be adopted,
00:54not translated into Tagalog.
00:57It might mislead the public, Your Honor.
00:59It's not misleading.
01:00In fact, I want the public to understand what it means.
01:03Because prima faci fraud,
01:04it may be technical for other people to understand, Your Honor.
01:11This is a trial.
01:12We do not try here rhetoric.
01:15We try here facts.
01:17This court explicitly said that it has not issued any subpoena to this particular witness,
01:24and neither has it issued any authority for this witness to be handed over certain documents or specific documents,
01:32especially documents containing confidential data.
01:35I would like to correct the good defense counsel.
01:39It's not a supposed forensic report.
01:42It is a forensic report.
01:44The person is not a stranger.
01:47His name is Attorney Alexander B. Cabrera.
02:07Your Honor, before the witness answer.
02:10Yes, Attorney.
02:12We would rather have this undeclared cash as alleged because this is still subject to cross-examination
02:21and offer of evidence and has not been proven as a fact yet.
02:25So, may we ask the Council if that can be used.
02:29The term alleged will be used.
02:32I don't think, if I may respond, Your Honor.
02:34I don't think the defense can dictate what words will come out of my mouth.
02:48195 million, 692 thousand and 505 pesos po.
03:05817 million, 874 thousand and 867 pesos po.
03:47Okay.
03:48****
03:55You
