"WALA NANG OBSTACLE PARA MAGPRISINTA DAPAT ANG DEFENSE"

House private prosecutor Atty. Lorna Kapunan said the impeachment court’s recent rulings have cleared the way for Vice President Sara Duterte’s defense to start submitting evidence when the trial resumes on Monday, Nov. 9.

During a press conference on Friday, Nov. 6, Kapunan noted that the court’s decision to accept the prosecution’s evidence and reject the defense’s objections to attaching documentary exhibits to the impeachment complaint and using subpoenas to get records. She said the complaint only needs to show the main facts and that using subpoenas is within the court’s authority, not a “fishing expedition.”

The court also accepted Duterte’s financial records from before she became vice president. The prosecution plans to use these as a baseline to review her income and net worth. Kapunan explained that admitting evidence does not mean the court agrees with the prosecution’s claims, since the senator-judges still need to consider the value of each piece of evidence. 00:00Pangalawa, yung order on admissibility of our evidence.
00:14What does that mean?
00:15One of the objections to the evidence of the prosecution is yung mga prinisinta daw na documents sa impeachment court,
00:26hindi naman naka-attach daw sa impeachment complaint, and therefore, dapat i-exclude.
00:35Ang Saba, tama ang ruling ng presiding officer.
00:39Ang isang impeachment complaint, alam natin lahat dyan.
00:47Because a complaint must only have what is called ultimate facts.
00:52Ultimate facts, who, what, where, when, how.
01:20Nakita nyo naman, we had how many boxes, 52, iambang 52 boxes namin of evidence, i-attach sa complaint.
01:28So, sabi ng presiding officer, that ground has no merit.
01:34Pangalawa, sinabi nila fishing expedition.
01:37Eh, hindi naman po daw fishing expedition.
01:40Ano, itong impeachment, yung officer, yung offer of exhibits namin, ano?
01:53Eh, that is the nature of the beast.
02:06So, it is not a fishing expedition.
02:08It is within the power of the impeachment court to issue subpinas to produce documents.
02:18Hindi po fishing expedition yan.
02:21Pangatlong reason dyan, eh, bakit daw yung mga nangyari before she became vice president in 2022,
02:31yung mga bank accounts niya, yung mga insurance policies niya, yung mga investments niya,
02:37bakit pa inalaw ng impeachment court?
02:41Ang sabi ng presiding officer, this is admissible.
02:46Establish mo ang baseline.
02:48To establish a baseline.
02:50Anong ibig sabihin?
02:51Ano yung baseline?
02:53Siyempre, pag ganito ang income mo ng 2025,
02:57saan nanggaling yung income?
02:58Di papakita mo yung earlier, no?
03:01Yung earlier income at paano naging ganito ng 2025.
03:07So, all the records have been admitted.
03:12All the evidence, testimonial, and documentary have been admitted by the impeachment court
03:20through the presiding officer.
03:23Isa lang ang excluded doon, yung papers regarding JTC, no?
03:27Kasi, excluded doon, yung JTC Corporation na owned by isang Mr. Cruz, no?
03:39So, that is the only evidence excluded.
03:42So, anong ibig sabihin nun?
04:07Ano?
04:07Ano ang weight?
04:09Ano ang weight?
04:11Nang ebidensya nito?
04:12So, ito ba ay meritorious to explain unexplained wealth, no?
04:18So, yung admissibility is not a ruling on probative value or on the merits of the evidence itself, no?
04:27Iba pa yan.
04:29So, yun ang dalamang orders ng presiding officer.
04:34At wala nang obstacle, no?
04:48prosecution, ano?
04:49So, we're very happy that that was timely ruled upon today.
