'WALANG MISTRIAL. THE DEFENSE DID NOT OBJECT'

Palace Undersecretary Claire Castro said there was no “mistrial” in Vice President Sara Duterte’s impeachment trial, countering defense lead counsel Atty. Sheila Sison’s remark that the prosecution’s decision to withdraw three articles of impeachment could lead to one.

During a press briefing on Thursday, Oct. 15, Castro explained that a mistrial occurs when a party is not given the opportunity to present its side. However, she pointed out that the defense team had ample time to cross-examine the witnesses presented by the prosecution.

Castro also maintained that if the defense believed the withdrawal could lead to a mistrial, it could have objected but chose not to. (Video courtesy of RTVM)

00:00Ang mistrial kasi pag sinabi natin, the other party was not given any chance to present herself.
00:10I was not given the chance to present evidence.
00:19But in this case, since nagkaroon ng cross-examination,
00:27generally, personally, on my part, hindi siya matatawag na mistrial.
00:32Kung hindi nagkaroon ng cross-examination, the other party was not given the chance to cross-examine,
00:37the witness is presented, then that's the time that we can say that there's a mistrial.
00:42Pero sa sitwasyon na to, walang masasabing mistrial because they were given ample time and opportunities
00:52to cross-examine the witnesses presented by the prosecution.
00:56And again, the defense team did not make any objection regarding the motion to withdraw the three articles of impeachment.
01:12Okay?
01:13Ulitin ko, ang defense team, ang mga lawyers ng vicepresidente,
01:19hindi sila nagbigay ng anumang objection.
01:26Manifestation lang ang kanilang sinabi.
01:30So, kung wala natanggap na objection from the defense team,
01:37ibig sabihin, impliedly, ay sumang-ayon sila sa withdrawal.
01:43Otherwise, kung ayaw nila at masasabi nila may mistrial,
01:48they should have objected to the motion to withdraw the three articles of impeachment
01:55and they should have insisted that they would present evidence to refute the allegations
02:04on the three articles of impeachment.
02:07Pero wala po kasing objection.
02:09So, maliwanag yan.
02:11Dahil tinanong siya ni Senator Judge Chase Escudero
02:15na yung kanya bang manifestation should be considered as objection.
02:21And she said, no.
02:22It's just a mere manifestation.
02:25So, walang objection.
02:39So, walang objection.
