The Delhi High Court is set to hear a petition challenging the continued judicial custody of Cockroach Janata Party leaders Sourav Das and Ashutosh Ranka in Tihar Jail. The duo challenged the 19th October order after a magistrate extended their detention till 21st October and rejected their sureties. Investigators and police maintain that the leaders deliberately breached their signed peace bond, which barred them from participating in illegal protests for a year. Authorities alleged that the leaders trespassed into the de-notified protest site at Jantar Mantar, breached police barricades, and obstructed public servants from carrying out their duties. Meanwhile, the petitioners argue that they possess a democratic right to hold peaceful protests, questioning their detention. While party founder Abhijit Dipke called Das and Ranka the real decision-makers and announced a halt on protests until Diwali, opposition voices accused the administration of arbitrarily arresting student leaders and suppressing dissent.

00:00Delhi High Court to hear a plea by Kaukrat Janata Party leaders who are still in custody, Saurav Das and
00:05Ashutosh Ranka.
00:06In just a short while, the Delhi High Court will hear this petition by the CJP.
00:11A special bench will hear the plea by the two Kaukrat Janata Party's main leaders, Saurav Das and Ashutosh Ranka,
00:17who were in five-day custody in the Tihar Jail.
00:19Two more days of custody given the festive season.
00:22The investigators believe that it could disrupt the festivities,
00:26especially at a time like this when they are trespassing into even denotified protest sites like Jantar Mantar.
00:31So the hearing will be in Delhi High Court special bench and in just a short while it will begin.
00:36Remember what the petitioners have been saying is that is this deserving,
00:41the manner in which they have been put behind bars and that they have every right for a democratic peaceful
00:46protest.
00:47But the police have said that they signed a peace war.
00:50They agreed that they are not going to be a part of illegal protests, violent protests
00:55and they will follow and maintain law and order.
00:57Instead, what they did was they jumped and trespassed, is the word used,
01:01into Jantar Mantar, which was denotified as a protest site.
01:05They participated in a protest despite the police personnel deployed.
01:09They're telling them to move away and had a scuffle with them as well.
01:12So that's also obstructing a public servant from imparting duties.
01:16So we'll be tracking what the court says with this.
01:18But the legal battle is over.
01:20With the continued detention of the CJP leaders and that's attracting a showdown.
01:24Saurav Das, Ashutosh Ranka.
01:26Young leaders, they have now reached the Delhi High Court.
01:29The party's request for an urgent night hearing was rejected.
01:32The matter will be now heard in just a short while.
01:35Kokrut Janata Party has challenged the 19th October order,
01:38arguing there is no basis to reject the sureties or extend the duo's custody.
01:43The magistrate extended their judicial custody till 21st October, rejecting the surety.
01:47The court said they had deliberately breached their own peace bond that they had signed,
01:52showing complete disregard for the law and order and posed a risk to public tranquility.
01:57It also said that their assurances against repeating the alleged acts failed to inspire confidence that they wouldn't repeat the
02:04same again.
02:05Announcing no more protests, at least till Diwali,
02:08CJP founder, Abhijit Dipke said,
02:09Saurav Das and Ranka were the party's real decision makers.
02:13That they simply followed the lead.
02:15And with, remember, the special executive magistrate who is hearing the matter today,
02:20the question is whether Das and Ranka will get relief,
02:22or their custody will be extended again.
02:24If it gets extended,
02:26how many days more for Saurav Das and Ranka,
02:29for breaching the peace bond,
02:30and they will have to be in Tihar chain.
02:33I always think that this movement,
02:35if someone has increased in the right way,
02:38that is Ashur and Saurav.
02:41They are very, very big role.
02:43I was only following their orders.
02:45I honestly tell you,
02:47my job was to follow Ashur and Saurav's orders.
02:50I always think that I am a leader.
02:51I was not a leader.
02:53It was Saurav and Ashur.
02:55They just told me,
02:57tomorrow you have to go here, tomorrow you have to do this,
02:59and I just have to do it.
03:02Because I know that the abilities and decision-making skills are better.

03:45the government and the government.
03:46What does this mean?
03:48This is not the government of the government.
03:53The government wants to bring the government here,
03:55and the government wants to bring the government.
03:58If we can't bring the government in our country,
04:01then what can we do?
04:03We can bring the government to whom?
04:05This will be the government's mission.
04:08And this is the responsibility of Modi, Shah and Paranwiji.
04:12And the government wants to bring the government in the coast.
04:15I may not agree with many of the CJP's mode of protest.
04:17I may not agree with some of their antics of CJP.
04:22That's a different argument.
04:23But I completely support CJP in terms of what the questions they want to raise.
04:27Fine. It is for the government to answer.
04:30But to arrest them for a violation,
04:33and again to drag them in terms of how they spend their time in a jail,
04:36that is only going to make the leaders of CJP more stronger, I'm afraid about it.
04:43Let's get down straight to the facts.
04:45What was the peace condition, the bond that these two leaders signed,
04:49and then according to the police, violated?
04:51The bond said, cannot participate in the illegal stir.
04:56So what did the CJP leaders do?
04:58They breached the barricades and entered into Jantar Mantar,
05:01which was clearly then mentioned as a denotified site.
05:04The peace condition as mentioned in the bond was,
05:07the timeline is a one-year.
05:09You will not be a part of illegal violent protests.
05:12The CJP leaders, without approval and within a day or two,
05:16entered into a premises that had clearly been barricaded.
05:19So police says this was trespassing into a territory, a zone,
05:24that was clearly denotified that they had no business coming in,
05:27and then stopping the police personnel from duty.
05:29The peace bond clearly stated, can be arrested if the norms are breached.
05:35The leaders knew what the bond was, they signed it,
05:39and yet they went toward Jantar Mantar,
05:41where there was a bit of scuffle also reported with the police personnel.
05:45And that is the reason that the police is claiming in the court,
05:48that they have done this once, why wouldn't they do it again?
05:51So now it remains to be seen if the magistrate will go ahead and give relief,
05:55or will the custody continue in Tehaar jail for Saurav Das and Ashutosh Rang.
