00:01It was a crime that rocked Cairns early last year.
00:05A woman raped multiple times in her home by two teenage intruders,
00:10while a third boy held her partner at knifepoint.
00:13Today, Judge Joshua Trevino has delivered his judgement on that third boy,
00:18finding him guilty of a single count of rape.
00:20It's been more than a fortnight since a three-day judge-alone trial
00:24in the Children's Court of Queensland heard how the 17-year-old detained the man.
00:28Now, the boy pleaded guilty to the break-in, but pleaded not guilty to five counts of rape.
00:33He argued he didn't know his co-offenders intended to sexually assault the woman
00:37and thought they were only going to rob her.
00:40But prosecutors argued the boy knew they intended to rape her
00:43and that he was liable for rape
00:45because he detained the person who could have intervened to prevent it.
00:49Now, today, Judge Trevino found the boy guilty of a single count of rape
00:53and not guilty of the four other counts.
00:55He didn't read his reasons during the brief court hearing,
00:58but those have now been published.
01:00In the 37-page document, Judge Trevino said the boy knew his co-offender intended
01:05to commit one act of rape because he heard him say so in the home.
01:09However, he found the boy didn't know about other acts that followed.
01:13The boy's been in custody since his arrest in February last year
01:16and the court heard it's unclear whether he'll be able to be sentenced before the end of this year.
01:21The two co-offenders, who are also aged 17, have pleaded guilty to the rapes
01:26and they're due to be sentenced next month.
