00:01Dato' Sri Najib Razak's house arrest should be put on hold.
00:05The Attorney General's chambers has asked for a temporary suspension,
00:10citing a legal question over his pardon.
00:13This comes after Najib's RM50 million fine was paid on Friday,
00:17and the High Court issued an order of discharge on payment of fine.
00:21The AGC says there is a legal question over the conditional pardon order of September 18,
00:27specifically on whether paying the fine ends only the fine component
00:32or the entire SRC International sentence.
00:36Under the first interpretation, the prison sentence is still running until August 23,
00:412028, and house arrest is only an alternative place to serve it.
00:47Under the second, payment of the fine allows the pardon to take full effect,
00:52meaning the whole sentence is deemed completed.
00:54Thus, a clear and final legal clarification must be obtained
00:59before further enforcement action is taken.
01:02The AGC adds that the issue affects Najib's 1MDB sentence,
01:07which is set to begin after the SRC sentence ends.
01:11The High Court rejected his bid for a stay of execution in the 1MDB case on October 14.
01:17Until the matter is clarified, the AGC says Najib's detention status should be maintained
01:24at the existing place of detention.
01:26The AGC stresses that the suspension is not meant to question or undermine
01:31the decree of the Yang Di-Pertuan Agong, but to ensure the decree and court orders
01:36are carried out accurately and in line with the true legal position.
01:40The AGC says it will take further action once its examination is complete.
