The Supreme Court has issued contempt notices to the Union Home Secretary, Delhi Police Chief, and Delhi Metro Chief over detentions, road and metro closures, lack of traffic advisories, and train cancellations in the national capital. Hearing a habeas corpus plea alongside contempt allegations concerning nearly 7,000 preemptive detentions under Section 163 of the Bharatiya Nagarik Suraksha Sanhita, the court directed top officials to file compliance affidavits by October 13 without mandating personal appearance. The bench ordered that normal metro, train, and internet services must function unhindered, barricades be reviewed, and restriction signboards outside the court premises be removed immediately.

00:00Now breaking news right at the top. This is what Supreme Court has now come out to say with regards
00:06to the detentions that have been taking place across the national capital since October 10th.
00:12Supreme Court finds contempt in Delhi detentions and there's a notice that's now been given to Home Secretary, Delhi Police
00:19Chief and the Delhi Metro Chief.
00:21SC doesn't ask for personal appearance of the top officials but seeks affidavit and compliance report by October 13th, that
00:30is Tuesday.
00:31SC notice on habeas corpus flea at this given point but yes, this is what we are given to understand.
00:39Remember earlier in the day when that special bench in fact heard the case with regards to all that happened
00:45over the last 24 hours.
00:48Around 7,000 detentions that have been reported from the national capital, all mostly in fact protesters that in fact
00:59got preemptively detained.
01:01That is what the police had to say that they had collected in numbers despite there being an imposition of
01:07section 163 of the BNS's and which is why in a preemptive measure they got detained.
01:13But that has now been condemned by the Supreme Court and a notice has been issued.
01:19Let me take this up with Anisha Mathur who's joining us on the broadcast with more details on the same.
01:25Anisha, very good afternoon to you.
01:27This is what the SC has to say that at the end of the day these detentions, why have they
01:33taken place?
01:34There are three of them who these notices have gone to.
01:37They have to in fact file an affidavit and give proper report of what exactly was the reason behind detaining
01:45around 7,000 people from the national capital.
01:48Well, let's demarcate the difference between the detention petition and the contempt petition.
01:55Notice of contempt has been given with regards to the closure of roads, closure of metros, lack of traffic advisory
02:03and cancellation of trains.
02:07That is where the contempt notice has been issued to the Home Secretary, the DNRT Chair and the Delhi Police.
02:16On the other side is the habeas corpus petition which had raised allegations of illegal detention.
02:23It had raised the allegations of assault on protesters, beating up of protesters, beating up of lawyers, detention of journalists
02:32and several other allegations including internet shutdowns.
02:35And detention of persons outside of the designated 4-kilometer area where Section 160 prohibition had been imposed.
02:45On that note, on that petition, the court has directed a response to be filed by all parties including the
02:55Home Ministry, including the Delhi government and the police.
02:58Now, there what the court has said is that metro train railways have to function normally, free movements shall be
03:08ensured, barricades need to be reviewed, internet will function unhindered.
03:14And that is a clear order by the court that internet shutdown cannot happen in this manner.
03:20There cannot be illegal detention, particularly when there are peaceful, unarmed protests anywhere outside of the specific 4-kilometer radius
03:30around Jantarwantar, where 163 prohibition is in operation.
03:35In fact, the court specifically noted that there was a notice board outside the Supreme Court premises on Bhagwanda's court
03:43where that curfew had been imposed.
03:45And the court directed that it has to be taken down immediately so that entry exit into court is not
03:51restricted whatsoever.
03:53The court also took note of the allegations based by the lawyer that lawyers who had gone to police stations
03:59to look for the detained person, to get people out.
04:05Those people were also assaulted.
04:07There are two parts to this particular directive that's been issued by the Supreme Court, as Anisha has pointed out.
04:14One is a notice of contempt that despite October 9th, the SC clearly mentioning that complete curbs on roadways, railways
04:23and metro lines will not be allowed and should not take place on October 10th.
04:26But we did see 45 metro stations were shut yesterday, despite all of what was heard in the entire case
04:34being heard by the Supreme Court itself.
04:35And the second part of this notice is the one that the directive is a notice that's gone out to
04:40the Home Secretary, the Delhi Metro Chief, as well as the Delhi Police Chief, which they will have to be
04:45submitting a report over by October 13th.
04:48So those are the two directives that's come in from the Supreme Court as of today, October 11th.
