July 25th I submitted a HIPAA Complaint with The U.S. Department of Health and Human Services (HHS) Office for Civil Rights (OCR) VS Experity & phone rep "Marjorie". I granted permission to access to my medical records through American Family Care Urgent Care with the understanding my X-Ray that was misread by Dr. Ana Maria Echenique M.D. would be reread and the error acknowledged. My injury was a broken basilar skull / head trauma. I called Experity in early April, 2022 to have it possibly reread. My calls were never returned. When I called back a week later I was told Experity mangaement made a decision that reread request could not be honored.

I also called and informed Experity CEO Dr. David Stern about my situation, this call was never returned or my issue addressed.

According to Bloomberg, Experity recently changed ownership in March, 2022 (involving Warburg Pincus & GTCR) in a deal possibly valued at around $1 billion dollars.

This American Family Care visit and X-ray here that was misdiagnosed led to 2 referrals: To a neurologist (Kyle Hudgens / Grandview Neurology) and orthopedic doctor (Perry L. Savage Sr. / OrthoAlabama Spine & Sports) $600 fee for these 2.

I believe I may have been "patient dumped" (a violation of EMTALA in hospitals) in the course of my seeking treatment for my injury. This pronouncement made it virtually impossible to get an accurate diagnosis elsewhere. I was also disabled and could not claim disability. My psychological state was routinely challenged because I claimed the doctors had missed the main injury. My concerns were unfairly dismissed and ignored.

00:01On July 25th, I filed a complaint with the U.S. Department of Health and Human Services, Office for Civil
00:10Rights, OCR, which enforces federal civil rights laws which prohibit discrimination in the delivery of health and human services based
00:21on race, color, national origin, disability, age, sex, religion, and the exercise of conscience and also enforces the health insurance.
00:30Portability and Accountability Act, that's HIPAA, HIPAA, Privacy Security, and National Breach Notification Rules.
00:44And this is in response to my dealings with Experity, that's E-X-P-E-R-I-T-Y.
00:53This is one of the largest service providers to urgent care clinics in the U.S.
01:01Supposedly, they deal with over 5,700 urgent care locations.
01:08I was a misdiagnosed patient.
01:11I had an X-ray misread by Dr. Anna Maria Echnik, MD DABR, who worked for Experity.
01:22And a phone number appeared on my radiologist doctor reading report, which said I had no injuries in 2019.
01:35I had her name and a phone number appeared below her name.
01:39I called the number, and this is the first time that I was aware of this company, telemedicine company, Experity,
01:51being involved in this.
01:53But I recorded all my telephone conversations back in April, dealing with Experity, trying to get this X-ray re
02:04-read.
02:05I paid $175 to this urgent care clinic, American Family Care, AFC Urgent Care.
02:12The location is Parkway East, Birmingham, Alabama, in Roebuck.
02:20I got my records from this clinic.
02:23In the picture, an injury is very obvious.
02:26It's in the basilar area of my skull.
02:29About a 3-inch diameter translucent oval appears in a standard X-ray image.
02:34There's a very thick mass of some kind.
02:38I had this X-ray taken because of pain in this exact area.
02:43I was told I had no injuries.
02:45Dealing with this company is totally unacceptable.
02:48I got the runaround.
02:49You can hear my calls.
02:51You can hear where I talk to these people, how they handle themselves in an unprofessional manner.
02:57This company, Experity, they brag they're worth a billion dollars to court investment.
03:05A company is worth a billion dollars, can't afford mistakes like what happened to me.
03:09I was a misdiagnosed patient who had an X-ray misread by Dr. Anna Maria Egnick, who worked for Experity.
03:17My injury was a broken basilar skull head trauma.
03:21I called Experity in early April 2022 to have the X-ray possibly re-read.
03:28I had this mistake acknowledged and possibly corrected or re-dressed.
03:36Nurse Marjorie Freisler, who worked with Experity, she only gave me Marjorie as her name on the telephone.
03:47She did not tell me that she was a nurse on the telephone.
03:53She had me give her and Experity rights to access my X-ray images via American Family Care and AFC.
04:06This was under the explicit understanding that those images were going to be used to re-read that X-ray
04:15for me,
04:17the patient who was misdiagnosed.
04:19And you can hear in the calls where she says this, this was our arrangement, our agreement.
04:25She broke her deal, okay?
04:27She broke the deal and she misused my information.
04:32When I gave permission for Experity to get these records, I was told I would be called in a few
04:42days.
04:42I was never called.
04:43You can hear over these many weeks of calls with Experity, I'm told many times by people that I'm on
04:51the phone with who work for Experity
04:54that they will return my call or have upper management return my phone call.
04:59My phone calls, as far as Experity goes, were never returned.
05:04They make obligations and they do not abide by them, okay?
05:10This is not professional business practices.
05:14When I had to call back a week later, I was told Experity management had stepped in and made a
05:21decision that our arrangement,
05:25the re-read request on the misdiagnosed X-ray could not be honored.
05:29And this is possibly a HIPAA concern, H-I-P-A-A.
05:34You can go and listen to my calls at YouTube channel My Medical Nightmare.
05:38You can hear exactly how I'm treated.
05:40This is unacceptable.
05:43I called the CEO of Experity, Dr. David Stern, and this phone call was not returned as well.
05:50He did not direct my call and have this issue addressed or cleared up.
05:56They would not help me after making this error.
